Citizenship and Immigration Canada (“CIC”) has announced its plans to implement a new pre-screening mechanism for foreign nationals who otherwise do not require a visa for entry into Canada, the Electronic Authorization Program (“eTA”). The regulations will come into force on August 1, 2015 with an enforcement date of March 15, 2016. Practically, this means the eTA application form will be available starting August 1, 2015, but the eTA requirement will not be enforced, and travellers will not be denied entry to Canada for failure to provide an eTA until March 15, 2016.
The purpose of this eTA Program is to determine the admissibility of a foreign national before they arrive in Canada, preventing situations where they are refused entry upon arrival.
The eTA Program will apply only to foreign nationals who arrive by air travel and who are able to enter Canada without a visa. The eTA program does not apply to U.S. nationals or foreign nationals who currently have a temporary resident visa or permit. However, these individuals with a work or study permit will be required to obtain an eTA if they leave Canada and re-enter via air travel.
Individuals will be required to apply for an eTA online on CIC’s website. Applicants will be charged a $7.00 processing fee and will receive their authorization electronically, typically within minutes. Notably for employers, individuals also applying for a work permit will not be charged the $7.00 processing fee. The possible responses an applicant can receive to their eTA application are:
eTA’s will generally be valid for a period of five years. However, CIC maintains the ability to rescind an approved eTA where it is discovered that an individual is inadmissible.
